9. Pricing, Quotes, and Orders

• We reserve the right to refuse or cancel orders due to suspected fraud, unauthorized activity, product availability issues, or inaccuracies.​

• Custom/special-cut orders may be subject to minimum order quantities, longer lead times, and specific terms.

10. Delivery, Lead Times, and Risk of Loss
 

• Standard lead time for special cuts: 2 weeks

• Stock items typically 1–2 days

• Custom builds 4–8+ weeks (subject to change).

Shipping options may include courier, LTL/FTL, sea/air freight. Risk of loss transfers per agreed Incoterms (e.g., EXW/FOB/CIF/DDP) and carrier policies.

Delivery timelines are estimates and not guaranteed. We are not liable for delays beyond our reasonable control.

11. Product Specifications, Certificates, and Warranties

​

• Specifications and applicable standards vary by product.

• Always refer to product datasheets and certificates.

• PHILGEPS registration or other certifications may be provided upon request and verification.

• Warranty: Products are covered by a lifetime warranty against factory defects as stated in the quotation or order acknowledgment.
   

Warranty Coverage:

​

Under normal use and installation, Hypertech Wire and Cable Incorporated warrants that its products will perform as specified for the lifetime of the product.

 

Terms and Conditions:

​

1. Warranty applies only to products that:
 

• Have been properly stored, handled, and installed by qualified personnel;

• Have been used within their specified electrical ratings and in compliance with Philippine electrical codes and regulations.

• Have not been subject to misuse, overloading or unauthorized alterations.
 

2. This warranty does not cover:
 

• Damage resulting from improper installation, poor storage conditions, or physical abuse;

• External hazards including, but not limited to, pest/rodent damage, chemical exposure, or extreme environmental conditions beyond product ratings;

• Damage caused by Force Majeure events (e.g., fire, flood, lightning, typhoon, earthquake, or power surges);

• Normal wear and tear cosmetic discoloration, or age-related degradation that does not affect functional electrical performance.

 

Claim Procedure:

​

1. To initiate a warranty claim, the client must:
 

• Present a copy of the sales invoice and provide a written description of the issue;

• Allow inspection by Hypertech's technical team.
 

2. If a product is determined to be defective under this warranty, Hypertech shall, at its discretion:
 

• Replace the defective product with an equivalent or superior item; or

• Provide a pro-rated refund based on the actual sale value of the product.

Limitation of Liability:

​

Hypertech Wire and Cable Incorporated shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, downtime, or damage to other equipment or property.
 

This Manufacturer’s Lifetime Warranty is extended only to the original purchaser and is non-transferable, unless otherwise agreed upon in writing.

12. Prohibited Uses

 

You agree not to:

• use the Site for unlawful purposes

• violate applicable laws or regulations

• interfere with Site functionality or security

• attempt unauthorized access to systems or accounts

• use bots, scrapers, or automated tools without written consent

Our total liability for any claim shall not exceed the amount you paid (if any) for accessing the Site, or PHP 5,000, whichever is lower, unless a higher amount is required by applicable law.

You agree to defend, indemnify, and hold harmless Hypertech and its affiliates from claims, liabilities, losses, damages, and expenses (including legal fees) arising out of:

19. Governing Law and Dispute Resolution

 

These Terms are governed by the laws of the Republic of the Philippines.

Any disputes arising from or relating to the Site shall be submitted to the exclusive jurisdiction of the courts of Bulacan, Philippines, unless otherwise required by law.

20. Termination
 

We may suspend or terminate your access to the Site at any time, with or without cause or notice, if you violate these Terms or misuse the Site.

Upon termination, your right to use the Site ceases immediately. Sections that reasonably survive termination (e.g., Intellectual Property, Disclaimers, Limitation of Liability) shall remain in effect.
